On August 7, the webinar “From Branding to Ban – What Can’t You Register as a Trademark?” was held, organized by ASIPI’s Harmonization and Case Law Committee. The session, broadcast via Zoom and Twitch, brought together specialists from across the region to analyze the legal barriers preventing the registration of trademarks linked to illicit activities or those contrary to morality.
Fernanda Chamorro, associate at Covarrubias specializing in industrial property and trademark matters, played a key role in the event as panel moderator, guiding the discussion and contributing her expertise in registrability criteria, comparative case law, and regional trends in trademark matters.
The webinar addressed key topics for professionals in branding, legal marketing, and industrial property, including:
· Legal limits on registering signs associated with prohibited activities.
· Recent cases of refusal and cancellation based on morality, public order, or deception.
· How to assess risks before filing trademark applications in different jurisdictions.
· Regional criteria for interpreting bad faith and other absolute grounds for refusal.
The panel featured recognized specialists from the region: Marta Fernández Pepper (Diez Canseco Abogados, Peru), Octavio Guerrero (Grupo AIEN, Mexico), and Pedro Vilhena (Gruenbaum, Possinhas & Texeira, Brazil).
Fernanda’s leadership helped articulate comparative perspectives and deepen practical recommendations to prevent errors that may result in objections, refusals, or future cancellations. Her role reinforces Covarrubias’ commitment to promoting legal knowledge and actively participating in technical initiatives led by ASIPI.
Through activities like this, the firm continues to strengthen its position as a regional reference in industrial property and regulatory analysis.
